Estes Termos de Serviço regem o acesso e o uso da PilotMP e descrevem o papel da PilotMP, dos Operadores e dos Tripulantes ao utilizar a plataforma.
1. What PilotMP Is
PilotMP is an online marketplace and technology platform that helps aircraft operators, charter companies, flight departments, aircraft owners, and other authorized hiring parties (“Operators”) connect with professional pilots and flight attendants (“Crew Members”) for potential crew engagements.
PilotMP provides technology for discovery, communication, document exchange, quotes, engagement confirmation, assignment management, and reviews.
PilotMP is not an employer, aircraft operator, air carrier, charter operator, or provider of air transportation.
PilotMP does not exercise operational control over any aircraft or flight.
2. What PilotMP Does
PilotMP may provide tools that allow:
- Crew Members to create professional profiles
- Crew Members to enter professional experience and qualifications
- Crew Members to upload and privately manage documents
- Operators to search and review Crew Member profiles
- Operators to post crew opportunities
- Operators to invite Crew Members to apply
- Crew Members to apply for opportunities
- Operators to request specific documents
- Crew Members to selectively share documents
- Operators and Crew Members to communicate through PilotMP
- Parties to discuss and negotiate compensation and engagement terms
- Parties to submit and respond to quotes
- Parties to confirm engagements
- PilotMP to generate engagement summaries, Crew Engagement Agreements, Trip Sheets, or assignment records
- Parties to manage confirmed assignments
- Parties to leave reviews following completed engagements
3. PilotMP’s Role in Engagements
PilotMP facilitates introductions and provides technology allowing Operators and Crew Members to communicate, exchange information, negotiate compensation and other engagement terms, document agreed terms, and manage assignments.
PilotMP is not a party to an engagement between a Operator and Crew Member unless PilotMP expressly agrees otherwise in writing.
The Operator and Crew Member are solely responsible for determining and agreeing upon:
- Compensation
- Payment method
- Payment timing
- Expenses
- Travel arrangements
- Per diem
- Cancellation terms
- Duties
- Scheduling
- Employment or contractor status
- Tax obligations
- Any other terms of their engagement
PilotMP does not collect a commission based on compensation agreed between Operators and Crew Members.
PilotMP does not require payment for crew services to be processed through PilotMP.
Operators and Crew Members may arrange payment directly between themselves.
4. What PilotMP Does Not Verify
Unless PilotMP expressly states otherwise for a specific verification service, PilotMP does not independently verify or guarantee:
- Pilot certificates
- Ratings
- Endorsements
- Medical certificates
- Medical fitness for duty
- Type ratings
- Currency
- Recency
- Flight experience
- Flight hours
- Training records
- Recurrent training
- Background checks
- Criminal history
- Passports
- Visas
- Legal right to work
- Identity documents
- Insurance status
- Employment eligibility
- Fitness for a particular aircraft, flight, operator, or role
- Compliance with an operator’s Operations Specifications or company requirements
Information displayed by PilotMP is based primarily on information supplied by users and platform activity.
5. Operator Responsibility
Operators are solely responsible for independently determining whether a Crew Member is qualified, eligible, current, trained, authorized, medically qualified, legally permitted, insurable, and otherwise suitable to perform the contemplated duties.
Operators are responsible for reviewing and verifying all information and documentation they consider necessary before engaging a Crew Member.
This may include:
- Pilot certificates
- FAA type ratings
- Medical certificates
- Training
- Recurrent training
- Flight experience
- PIC/SIC experience
- Recency
- Passports
- Visas
- Background information
- Insurance requirements
- Employment authorization
- Operator-specific requirements
PilotMP profile information, matching results, recommendations, badges, document statuses, and other indicators do not replace the Operator’s independent review.
6. Operational Responsibility and Operational Control
The Operator and the person or entity legally responsible for the aircraft operation are solely responsible for determining which laws, regulations, operating rules, Operations Specifications, company procedures, insurance requirements, and other requirements apply to the contemplated operation.
PilotMP does not:
- Dispatch aircraft
- Release aircraft for flight
- Conduct flights
- Direct flight operations
- Determine whether a particular flight may legally be conducted
- Exercise operational control over aircraft or flights
Nothing on PilotMP transfers operational control of an aircraft or flight to PilotMP.
PilotMP is a technology marketplace and does not provide air transportation.
7. Crew Member Responsibility
Crew Members are responsible for the accuracy and completeness of the information they provide through PilotMP.
Crew Members are responsible for determining whether they are legally qualified, current, medically eligible, properly trained, authorized, and otherwise able to accept and perform an engagement.
Crew Members must not knowingly provide false, misleading, fraudulent, or materially inaccurate information.
Crew Members should promptly update information when a material change affects their qualifications, availability, or ability to perform an engagement.
Providing fraudulent or intentionally misleading information may result in account suspension or termination.
8. Matching and Recommendations
PilotMP may use information supplied by Operators and Crew Members to identify, rank, recommend, or display potentially relevant Crew Members for an opportunity.
Features such as:
- Match percentages
- Strong Match
- Type-Rated Match
- Model Experience Match
- FAA type-rating indicators
- Aircraft-experience indicators
- Availability indicators
- Recommended Crew
- Best Match
are marketplace matching tools only.
They do not constitute a determination by PilotMP that a Crew Member is:
- Legally qualified
- Operationally eligible
- Current
- Insurable
- Approved by an operator
- Suitable for a particular flight
- Guaranteed to satisfy regulatory requirements
Operators remain responsible for independently evaluating Crew Members.
9. Documents and Privacy
Documents uploaded by Crew Members remain private unless the Crew Member chooses to share them as permitted by PilotMP’s document-sharing controls.
A Crew Member may choose to share a specific document with a specific Operator.
A Operator’s document status, including:
- Reviewed
- Accepted for this assignment
- More information requested
- Expired
- Not accepted
applies only to that Operator and assignment unless PilotMP expressly states otherwise.
A Operator’s review or acceptance does not create a platform-wide approval or verification of the Crew Member.
Document availability through PilotMP does not mean PilotMP has independently authenticated the underlying credential.
10. Platform Trust Indicators
PilotMP may display indicators such as:
- Email confirmed
- Phone confirmed
- Profile completed
- Documents available
- Responsive
- Recently active
- Completed assignments
- Repeat Operator
- Positive reviews
These indicators describe platform activity only.
They are not aviation credential verification or a determination that a Crew Member is qualified for a particular operation.
11. Engagement Confirmation
When a Operator and Crew Member reach an agreement, PilotMP may provide an engagement-confirmation process.
The confirmation process may record terms such as:
- Operator
- Crew Member
- Aircraft
- Position
- Dates
- Route or location
- Compensation
- Estimated engagement amount
- Expenses
- Travel responsibilities
- Per diem
- Cancellation terms
- Documents provided
- Other agreed terms
An engagement is considered “Confirmed” within PilotMP only after the confirmation steps required by the platform have been completed.
PilotMP may generate:
- An Engagement Summary
- A Crew Engagement Agreement
- A Trip Sheet
- An Assignment Record
- Confirmation emails
These records are generated from information supplied or accepted by the parties.
PilotMP does not independently determine whether the engagement is legally, operationally, or commercially appropriate.
12. Electronic Acceptance
Where PilotMP allows users to accept engagement terms electronically, actions such as selecting “Accept Engagement”, “Confirm Engagement”, or a substantially similar control may evidence the user’s acceptance of the terms presented at that time.
PilotMP may maintain electronic records including:
- User accepting
- Date
- Time
- Agreement version
- Job ID
- Assignment ID
- Engagement terms
- Other relevant transaction records
Users are responsible for reviewing the engagement terms before accepting them.
Material changes to accepted engagement terms may require renewed acceptance by both parties.
13. Pre-Confirmation Communications and Contact Information
PilotMP provides messaging and communication tools so Operators and Crew Members can evaluate potential engagements and negotiate terms.
Before an engagement is confirmed through PilotMP, users may not intentionally use PilotMP messaging, profiles, documents, or other platform features primarily to exchange direct contact information for the purpose of bypassing PilotMP’s engagement-confirmation workflow.
This may include intentionally exchanging:
- Personal telephone numbers
- Personal email addresses
- WhatsApp or other messaging identifiers
- Social-media handles
- Other direct-contact information
for the purpose of moving an active PilotMP hiring discussion outside PilotMP before the engagement has been recorded.
PilotMP may use automated systems to detect or restrict the transmission of apparent contact information before engagement confirmation.
Automated systems may occasionally identify information incorrectly.
This restriction does not prevent users from providing information reasonably necessary to evaluate qualifications, satisfy legal or regulatory requirements, respond to emergencies, or comply with applicable law.
14. Contact Information After Engagement Confirmation
After an engagement has been confirmed through PilotMP, PilotMP may make authorized contact information available to the Operator and Crew Member.
Following confirmation, the parties may communicate directly using:
- Telephone
- Text messaging
- Other messaging services
- Any other communication method they choose
The parties may also arrange and make payment directly between themselves.
PilotMP does not require post-confirmation communications or payments to remain on the platform.
15. No Circumvention of Engagement Recording
PilotMP’s engagement-confirmation process exists to:
- Maintain accurate assignment records
- Support assignment management
- Generate engagement documentation
- Enable reviews
- Maintain marketplace integrity
- Provide useful marketplace analytics
Users may not intentionally use PilotMP to identify or communicate with another user and then falsely represent to PilotMP that no engagement occurred for the purpose of avoiding PilotMP’s engagement-confirmation process.
PilotMP may ask users to update the status of a job, candidate, conversation, or assignment when platform activity indicates that a hiring decision may have occurred.
PilotMP does not charge a transaction commission.
This provision does not prohibit Operators and Crew Members from arranging payment independently after an engagement has been confirmed through PilotMP.
16. Compensation and Payment
Operators and Crew Members negotiate compensation directly.
Unless PilotMP expressly introduces a separate payment service, PilotMP is not responsible for:
- Payment of crew compensation
- Collection of crew compensation
- Payroll
- Payroll taxes
- Tax withholding
- Tax reporting between the parties
- Expense reimbursement
- Payment disputes
- Chargebacks
- Collection of unpaid amounts
The Operator and Crew Member are responsible for maintaining appropriate records regarding compensation, expenses, reimbursements, and taxes.
17. Employment and Contractor Classification
PilotMP does not determine whether a Crew Member is:
- An employee
- Independent contractor
- Agent
- Temporary worker
- Or otherwise classified
with respect to a Operator.
The Operator and Crew Member are responsible for determining the appropriate legal, tax, employment, and regulatory treatment of their relationship based on applicable law and the actual circumstances of the engagement.
Nothing displayed by PilotMP is intended to establish a particular worker classification.
18. Changes and Cancellation
Operators and Crew Members are responsible for agreeing upon cancellation policies and changes to an engagement.
Where PilotMP provides tools to revise confirmed engagement terms, material changes may require acceptance by both parties before PilotMP records the revised terms as confirmed.
PilotMP is not responsible for:
- Cancellation fees
- Travel expenses
- Lost income
- Replacement crew costs
- Repositioning expenses
- Other losses arising from cancellation or modification
unless PilotMP expressly agrees otherwise in writing.
19. Assignment Completion and Reviews
Following an engagement, PilotMP may ask the Operator and Crew Member whether the assignment was completed.
Users agree to provide accurate information regarding assignment status.
Confirmed or completed engagements may be used to provide platform functionality such as:
- Assignment history
- Completed assignment counts
- Repeat-operator indicators
- Marketplace analytics
- Reviews
Reviews must reflect the user’s genuine experience and may not contain fraudulent, unlawful, threatening, abusive, or intentionally misleading content.
20. Moderation and Platform Enforcement
PilotMP may moderate or investigate:
- Fraud reports
- Abusive behavior
- Misleading profiles
- Prohibited content
- Document-sharing complaints
- Account misuse
- Intentional circumvention of the engagement-confirmation workflow
PilotMP may take reasonable measures to protect users and platform integrity, including:
- Restricting certain contact information before engagement confirmation
- Warning users about prohibited communications
- Requesting confirmation of assignment status
- Restricting platform functionality
- Suspending accounts
- Terminating accounts for repeated or material violations
PilotMP may consider context when enforcing these provisions.
An accidental transmission of contact information should not automatically be treated as intentional circumvention.
21. No Guarantee of Engagement or Performance
PilotMP does not guarantee that:
- A Operator will hire a Crew Member
- A Crew Member will accept an engagement
- Either party will perform an engagement
- Compensation will be paid
- An assignment will occur as scheduled
- Information supplied by a user is accurate
- A particular Crew Member will satisfy an operator’s requirements
- A particular Operator will be suitable for a Crew Member
- Use of PilotMP will result in any particular outcome
Each user is responsible for their own decisions and dealings with other users.
22. Platform Analytics
PilotMP may use information regarding:
- Searches
- Profile views
- Invitations
- Applications
- Communications
- Quotes
- Engagement confirmations
- Assignments
- Completion status
- Reviews
- Other platform activity
to operate, secure, analyze, and improve PilotMP, subject to the PilotMP Privacy Policy.
Marketplace analytics do not change the legal relationship between PilotMP, Operators, and Crew Members.
23. No Warranty
PilotMP is provided “as is” and “as available.”
To the maximum extent permitted by applicable law, PilotMP disclaims warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.
PilotMP does not warrant or guarantee the conduct, qualifications, performance, reliability, legality, or suitability of any Operator or Crew Member.
24. PilotMP Is Not a Party to Crew Engagement Agreements
A Crew Engagement Agreement, Engagement Summary, Trip Sheet, or assignment confirmation generated through PilotMP records information and terms agreed between the Operator and Crew Member.
PilotMP is not a party to that agreement unless PilotMP is expressly identified as a party in writing.
The Operator’s and Crew Member’s use of PilotMP remains separately governed by these Terms of Service.
